TERMS OF BUSINESS

I tried to make this as simple as possible, as I believe the voice of the brand should be applied to everything, including documents such as terms of business and contract, which are typically expected to be full of legal terminology. If you haven’t caught it yet, let me make it easier for you: The voices of DigiKamran are;

  • Sufficient, yet brief and bullshit-free
  • Minimalist, yet comprehensive
  • Super creative, yet meaningful
  • Conceptual. Honest. Authentic.

Although the language of this document is uncomplicated, the intentions are no laughing matter. These terms of business are under the exclusive jurisdiction of English courts.

THE PROJECT

Project details and structure depend on many conditions. However, the general procedure consists of a few steps:

Firstly, I will interview you or ask you for the brief. Don’t worry. I will prepare the required brief inquiries and present them to you. 

According to the brief, you’ll accept my short proposal for the project. You should agree and sign-off the proposal to get me to start the work.

If it’s not a very small task, I’ll probably need some time for in-depth research, analysis, concept, and idea generation before getting to the actual part.

Then I’ll prepare the initial draft and send it to you to check if we are on the same track. If yes, I’ll go on and finish it. If not, we’ll discuss irrelevancies and fix them.

COPYRIGHT

When I have received full and final payment as described in this agreement, copyright of the work I produce is automatically assigned to you. You can then use the work however you wish.

However, until the final payment is received, the copyright of the work remains with me.

I love to show off my work, so I reserve the right to share my experiences with the project and link to your completed project as a part of my portfolio (ghostwriting projects are exceptions).

DEADLINES

I believe in hitting deadlines, but I can only do this with your help. So, I can’t be responsible for a missed deadline if you have been late with a down payment, slow to supply materials, or not provided feedback to agreed timescales.

As you would also understand, I also can’t be responsible for deadlines missed due to circumstances entirely beyond my control, like floods, war, family emergencies, illness, acts of God, and so on.

Usually, a deadline is agreed upon for the delivery of the first draft content. We can agree on timeframes for further changes later, but I’ll do everything I can to meet your needs.

COSTS AND PAYMENT

My proposal will explicitly show the price of the services I’ll do for you. Price calculation can be in three forms depending on the project and your preferences:

  • One-time fixed fee
  • Defined costs for the separate components of the project
  • Time-based (per hour, per day, or month)

If I have not received any feedback or comments within below timeframes of submitting work to you, I will assume you are happy the assignment has been completed and will invoice for the remaining balance:

  • Seven business days for the first submission of the final work
  • Three business days if you have requested at least one revision

I’m not registered for VAT, and my payment terms are 30 days after the invoice date.

Additional exclusive details concerning costs and payment will be included in the proposal.

CANCELLATION 

Oh, no! Let’s try to figure out a way to save our lovely agreement.

If we can’t, and the agreement is seized by you, me, or both before the project finishes, I’ll refund all that you’ve paid me for this project as soon as possible in 30 days.

LEGAL STUFF 

I will do my best to ensure all facts and statements in my work are true and that it doesn’t infringe upon any copyright or other rights of third parties.

However, I can’t be liable to you or any third party for damages, including lost profits, lost savings, complaints, claims, litigation, or other incidental, consequential, or special damages that arise regarding the assignment. 

If any provision of these terms of business shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the terms of business and shall not affect the validity and enforceability of any remaining provisions.
